1. Acceptance of Terms
By accessing or using SiteHealth ("the Service"), operated by Softest, a company based in the United Arab Emirates ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
2. Description of Service
SiteHealth is a website and infrastructure monitoring platform that checks the availability, performance, and health of your websites, APIs, and services. We provide uptime monitoring, SSL certificate tracking, domain expiration alerts, status pages, and incident management tools.
3. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it up to date. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use the Service to:
- Monitor websites or services that you do not own or have authorization to monitor
- Conduct denial-of-service attacks, vulnerability scanning, or any form of security testing against third-party systems
- Violate any applicable laws, regulations, or third-party rights
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the Service in any manner that could disable, overburden, or impair our infrastructure
5. Payment Terms
Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees. All fees are charged monthly in advance. Promotional discounts apply only to the period stated with the offer. You can cancel at any time from your billing settings; your team moves to the Free plan and its limits apply. Fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice. Payment processing is handled by Stripe; their terms apply to payment transactions.
6. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible. We are not liable for any downtime, data loss, or service interruptions.
7. Intellectual Property
The Service, including its design, features, and content, is owned by SiteHealth and protected by intellectual property laws. You retain ownership of any data you provide to the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.
8. Limitation of Liability
To the maximum extent permitted by law, SiteHealth shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
9. Termination
You may cancel your account at any time through your account settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. We may delete your data within 30 days of account termination.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.
